Suggesions on Perfecting Chinese Food Safety Law

  • Though the Food Safety Law has been enforced since 2009, several items in the law need perfecting. Four suggestions in the paper are as follows: 1) subjects of right and responsibility have to be clearly defined in government supervision; 2) the Recall system needs to be detailed; 3) the most effective measure is to immensely upgrade the punitive damages from the present '10 times' of the food price to 'times' of the damage; 4) product liability insurance system should be enforced to protect the victim's legitimate rights and interests in infringement case. Only when the punitive compensation system and product liability insurance system are mandatory in the Food Safety Law, can it fully protect consumer's rights and health.
