Abstract:
With increasingly fierce international competition, rapid development of digital economy and fair competition becoming the trend of the times, how to implement anti-monopoly governance and achieve fair competition is the issue that must be resolved in the digital economy era. With the development of digital economy, the typical monopoly problems that may arise include price parity protocol, algorithm conspiracy, denial of data opening and so on. In response to these problems, EU has formed some anti-monopoly experiences, involving formulating anti-monopoly agreement rules, regulating algorithm collusion and data opening, etc. Learning from EU experiences, China can conduct anti-monopoly governance by taking the following approaches: improving competition policies in the field of digital economy, establishing a mechanism for identifying conspiracy algorithms, clarifying the legal status of competition element data, and strengthening the anti-monopoly regulation of digital platforms.
