Abstract:
In China's air passenger transportation, flight delay, flight overbooking and flight cancellation result in trip delay frequently. But airlines' disposal of passengers' travel delay often harms passengers' rights and interests.Drawing lessons from EU legal system that protect passenger rights and interests against flight rejection, cancellation or delay, this paper discusses to construct a legal system to handle passenger trip delay that covers flight delay, flight cancellation and flight overbooking. Such a law should ensure passengers the right to know the delay reasons and the oversold fact, and ensure the compensation realization of passenger claims. Of course, compensation for reasonable travel delay and unreasonable travel delay should be distinguished, and the scope of compensation and limits of liability be provided.
