司法改革背景下刑事审判裁判尺度统一问题研究——以S市两级法院的实践探索为例

Research on the Uniformity of Criminal Trial Scale under the Background of Judicial Reform:Taking the Practice Exploration of Two-Level Courts in S City as an Example

摘要: 司法改革背景下刑事审判裁判尺度统一面临新形势，对人民法院和员额法官的刑事审判工作提出了新要求，给人民法院的工作提出了新课题。文章以S市两级法院的实践为例，首先对刑事审判裁判尺度不统一的现实表现及原因进行了分析，然后重点从六个方面探讨了实现刑事审判裁判尺度统一的具体举措。

Abstract: Under the background of judicial reform, the standardization of criminal trials and judgments faces a new situation, which puts forward new requirements for the criminal trial work of the people's courts and judges and also puts forward new topics for the work of people's courts.Taking the practice exploration of two-level courts in S city as an example, this article firstly analyzes the actual performance and reasons of the non-uniformity of criminal trials, and then explores the specific measures to achieve the uniformity of criminal trials and judgments from six aspects.
