关于构建我国劳动合同期限制度的思考——基于部分国家与地区劳动合同期限的比较研究

On Constructing a Labor Contract Term System in China: A Comparative Study on Labor Contract Term Systems in Some Countries and Regions

  • 摘要: 我国劳动合同立法中有关无固定期限合同以及劳动合同期限的相关内容在理论上和实务中都引发了大量争议。本文考察了美、日、德、法及我国台湾地区在合同期限制度上的相关立法及做法,并以这些立法及做法为借鉴,提出以不定期合同为主体、定期合同为补充,限定定期合同的期限和适用范围,以解雇保护制度与不定期合同相配套,构建我国的劳动合同期限制度。

     

    Abstract: In theory and practice, there is a lot of controversy over labor contract legislation relating to non-fixed-term labor contract and the term of a labor contract. Based on comparative studies of legislation and practice in America, Germany, France, Japan, and China Taiwan, this paper proposes that labor contract term system in China should be constructed by giving priority to non-fixed-term contract, taking fixed-term contract as complements, stipulating the length of term and the scope of application for fixed-term contract, and forming a complete set by dismissal protection system and non-fixed-term contract.
