Abstract: The supervisory committee integrates the resources of anti-corruption, and centralizes supervise the public power, which is an important mechanism to deepen the reform of national surveillance system. The Standing Committee of the National People's Congress (NPC)About the Decision of Carrying out the National Supervisory System Pilot Work in Beijing City, Shanxi Province as well as Zhejiang Province indicates that "Anyone who suspected duty crimes would transferred to the prosecution according to law", whether the cases transferred by the supervisory committee need to be reviewed? The article consider, From the perspective of legislative program, the substance function of the prosecution, the protection of human rights, the evidence and so on, the procuratorate can effectively protect the function of procuratorial supervision, the cases transferred by the supervisory committee should be reviewed before prosecuting.
