Obstacles for Capital Subscription via Contractual Right of Land and Corresponding Legal Countermeasures

  • 摘要: 农村土地承包经营权的流转问题,不仅与农民的日常生产、生活息息相关,而且还直接关系到农业产业化经营的推进和农村土地利用效率的提升。作为一种新兴的资本运作方式,农村土地承包经营权出资有着充足的法律依据和迫切的现实需求,是城镇化建设的重要一环。但现有法律体系中关于农村土地承包经营权出资的规定还不够健全,在运行中还存在诸多问题,因此,应进一步完善农村土地承包经营权出资的法律制度。

     

    Abstract: The importance of the circulation of contractual right of land in Countryside lies not only in its close relationship with peasants' cultivation and living but also in its influence on the process of industrialization management of agriculture and the efficiency of land exploitation. As a rising mode of capital operation, capital subscription via contractual right of rural land, a key step in urbanization, is lawful and pressing. However, the legal stipulation of capital subscription via contractual right of rural land is far from sound and problems appear, which calls for perfection of it.
